Some 40 million Americans currently hold student debt, the White House said, with total debt outstanding now roughly $1.3 trillion. “Up until 1976, all student loans were dischargeable in Bankruptcy. After 1976 all student loans were dischargeable if they were in repayment for 5 years. In 1984 Private student loans were once again treated like all other unsecured debt and were dischargeable up until 2005 when the last time the Bankruptcy code changed to where both Private and government student loans were not dischargeable unless “undue hardship” exists. These rules are back up for review by the Obama Administration. How would any changes to the current rules affect Students or our financial and education system?
